Terms of Service
Last updated October 28, 2026
These terms are the agreement between you and Mocha. They explain what you can expect from the service and what we expect from you. The plain-language summary comes first; the details follow.
1. Who we are
Mocha is a personal AI companion operated by an individual sole proprietor based in the United States. In these terms, “we”, “us”, and “Mocha” mean that operator. “You” means the person using the service.
2. Accepting these terms
By creating an account, signing in, or using Mocha, you agree to these terms, our Privacy Policy, and our Acceptable Use Policy. If you do not agree, do not use the service.
3. Eligibility
You must be at least 16 years old to use Mocha, and you must be legally able to enter into a binding contract where you live. If you are under the age of majority where you live, you represent that a parent or guardian has reviewed and agreed to these terms for you.
4. Your account
You need an email address and password to sign in. Keep your credentials secure and do not share your account. You are responsible for activity that happens under your account. Tell us promptly at joeulam@bu.edu if you believe someone else has access.
5. The service
Mocha provides conversations with an AI assistant, memory you review and approve, projects, tasks, notes, knowledge sources you upload, dashboards, scheduled briefings, and optional connections to third-party services.
Mocha is currently provided free of charge. We do not collect payment details, and there is no subscription, trial, or billing relationship.
We may add, change, limit, or discontinue features. We may also impose reasonable usage limits to protect the service.
6. Your content
You keep ownership of the content you create or upload, including messages, notes, tasks, projects, memories, knowledge files, and dashboard layouts.
You give us a limited, non-exclusive, worldwide, royalty-free licence to host, store, copy, process, transmit, and display that content only as needed to operate Mocha and provide the features you use. This includes sending relevant content to third-party providers, such as AI model providers and the services you choose to connect, when a feature requires it. The Privacy Policy explains what is sent and how privacy modes affect it.
You are responsible for making sure you have the rights needed to upload your content and that it does not violate anyone else’s rights.
7. AI-generated output
Mocha uses artificial intelligence. Output can be inaccurate, incomplete, out of date, or biased, even when it looks confident. Check important facts before relying on them.
Mocha does not provide legal, medical, financial, or other professional advice. For those decisions, consult a qualified professional.
You are responsible for the actions you approve. Actions that write to connected services can change or delete real data and may not be reversible. Read the approval card before you approve anything.
8. Connected services
You choose whether to connect third-party services, such as email, calendar, document, spreadsheet, or task providers. When you connect one, you authorise us to access and exchange data within the permissions you grant.
Those services are operated by other companies. Their terms and privacy policies apply to them. We are not responsible for their availability, accuracy, or practices, and connecting a service does not give you any rights beyond what that provider offers.
You can disconnect a service at any time in Settings. Disconnecting stops future access. It does not undo actions already completed, and it does not delete data held by the third party.
9. Acceptable use
You must follow our Acceptable Use Policy. In short: do not use Mocha to break the law, harm people, violate privacy, attack systems, or misuse connected accounts.
10. Our content
The service, including its design, text, graphics, mascot, and software, is owned by us or our licensors and is protected by intellectual property laws. You may use the service as intended, but you may not copy, modify, distribute, sell, or reverse engineer it except where the law expressly allows.
If you send feedback, we may use it without restriction or obligation.
11. Availability, changes, and termination
We work to keep Mocha available, but we do not promise uninterrupted or error-free operation. Maintenance, provider outages, and security incidents can interrupt the service.
You can stop using Mocha at any time, and you can delete your account in Settings.
We may suspend or end your access if you violate these terms or the Acceptable Use Policy, if we are required to by law, or if continuing to provide the service would create a security, legal, or operational risk.
When your account ends, your right to use the service ends. Your data is handled as described in the Privacy Policy.
12. Disclaimers
Mocha is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the service will be uninterrupted, secure, or free of errors, or that any output will be accurate or suitable for your purpose.
13. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, or goodwill, arising from your use of or inability to use Mocha.
To the fullest extent permitted by law, our total liability for all claims relating to the service is limited to one hundred US dollars (USD 100).
Some places do not allow certain exclusions or limits, so parts of this section may not apply to you. Nothing here limits rights you have under mandatory local law.
14. Indemnity
To the extent permitted by law, you agree to defend and indemnify us against claims, losses, and costs, including reasonable legal fees, that arise from your content, your use of Mocha in violation of these terms, or your violation of another person’s rights.
15. Governing law and venue
These terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. To the extent permitted by law, you and we agree to resolve disputes in the state or federal courts located in New York.
16. Changes to these terms
We may update these terms. When we do, we will change the date at the top of this page. If a change materially affects your rights, we will give notice by email or in the app before it takes effect, where we reasonably can. Continuing to use Mocha after a change takes effect means you accept the updated terms.
17. General
These terms, together with the Privacy Policy, Acceptable Use Policy, and Cookie Notice, are the entire agreement between you and us about the service. If a provision is found unenforceable, the rest remains in effect. A failure to enforce a provision is not a waiver. You may not assign these terms; we may assign them as part of a transfer of the service. There are no third-party beneficiaries.
